Powens for Microsoft Dynamics 365 Business Central (addon)

1. Definitions
Addon: Refers to the Powens integration module for Microsoft Dynamics 365 Business Central.
Publisher: DATAIPA.PRO, owner of the intellectual property and exclusive distributor of the addon.
User: Any natural or legal person using the addon in Microsoft Dynamics 365.
Platform: Microsoft Dynamics 365 Business Central and Microsoft AppSource.
2. Intellectual property
The addon is the exclusive property of DATAIPA.PRO.
DATAIPA.PRO holds the exclusive rights to distribute, maintain, and market the addon on all Microsoft Dynamics 365 platforms.
The use of the Powens / Budget Insight trademark is permitted only for this addon, in accordance with the certification granted by Powens.
3. License Grant
Users have a non-exclusive, non-transferable, and revocable license to use the addon in their Microsoft Dynamics 365 environment.
The license is subject to compliance with these terms and conditions and all applicable Microsoft license terms.
4. Subscription and fees
The addon is provided on a subscription basis, with fees set in the commercial agreement or AppSource listing.
DATAIPA.PRO reserves the right to update prices with prior notice.
Failure to pay the subscription fee may result in suspension or termination of access.
5. Support and maintenance
DATAIPA.PRO provides technical support, updates, and compatibility maintenance for the ADDON.
Support is available via [support channel/email] during business hours.
Updates may include bug fixes, security fixes, and feature enhancements.
6. Data protection and compliance
The addon can process financial data through Powens APIs. All data processing complies with:
GDPR (EU Regulation 2016/679)
Applicable French data protection laws
DATAIPA.PRO does not store sensitive user data unless explicitly authorized to do so.
7. Exclusivity and certification
This addon is the only Powens certified integration for Microsoft Dynamics 365.
No other third-party solution is allowed to use the Powens brand on Microsoft AppSource.
8. Termination
The license may be terminated by either party with 30 days' notice.
Immediate termination may occur in the event of non-compliance with the terms, non-payment or misuse of the addon.
In case of termination, access to the addon will be revoked and data retention will follow the guidelines of the GDPR.
9. Limitation of Liability
DATAIPA.PRO will not be liable for indirect, incidental or consequential damages.
The liability is limited to the amount paid by the user for the addon in the last 12 months.
10. Applicable law and jurisdiction
These Terms are governed by French law.
Any dispute shall be subject to the exclusive jurisdiction of the courts of Lyon, France.
